RETURNS & REFUNDS POLICY (UNITED STATES)

1. Application of this Policy

This Returns & Refunds Policy applies to all purchases made from Birdies Garden Products USA Inc (“Company,” “we,” “us,” or “our”) within the United States.

All sales are subject to this Policy, our Terms of Service, and applicable U.S. federal and state law, including (where applicable) the Uniform Commercial Code (“UCC”).

 


 

2. No Change-of-Mind Returns

All sales are final.

We do not offer refunds, exchanges, or store credit for:

  • Change of mind

  • Incorrect selection

  • Ordering the wrong size, model, finish, or quantity

  • No longer needing the product

  • Price differences or promotions

Customers are responsible for ensuring products meet their requirements prior to purchase.

 


 

3. Damaged or Defective Products

If you receive a product that is damaged in transit or defective, you must:

  1. Notify us in writing within 5 calendar days of delivery;

  2. Provide proof of purchase;

  3. Provide clear photographs of:

    • The product

    • The packaging

    • The shipping label

    • The damage or defect

  4. Retain all original packaging.

Failure to notify us within this timeframe may void eligibility for a claim.

 


 

4. Inspection Requirement (Important)

Products must be inspected immediately upon delivery and before installation, assembly, alteration, or use.

We are not responsible for:

  • Damage discovered after installation or assembly

  • Damage resulting from improper handling, installation, or modification

  • Labor, installation, removal, or reinstallation costs

Installation or use of a product constitutes acceptance of the product.

 


 

5. Our Remedies

If a valid defect is confirmed, we may, at our sole discretion:

  • Repair the product;

  • Replace the product (in whole or part); or

  • Issue a refund of the purchase price.

We reserve the right to determine whether a product is defective.

Replacement products may be refurbished or reconditioned if commercially reasonable.

 


 

6. What Is Not Covered

The following are not considered defects:

  • Normal wear and tear

  • Minor cosmetic variations

  • Variations in color, finish, or texture

  • Environmental exposure (including corrosion, oxidation, weathering, salt, humidity) consistent with product specifications

  • Damage caused by:

    • Improper installation

    • Failure to follow instructions

    • Misuse or abuse

    • Modification or alteration

    • Acts of God

    • Commercial use where product is intended for residential use

 


 

7. Shipping Costs

If a claim is approved:

  • We will cover reasonable shipping costs for replacement of confirmed defective goods.

If the product is determined not to be defective:

  • Customer is responsible for return shipping; and

  • We may charge inspection, handling, and re-shipping fees.

Original shipping charges are non-refundable unless required by law.

 


 

8. Return Authorization Required

No returns will be accepted without prior written Return Authorization (RA).

Unauthorized returns may be:

  • Refused; or

  • Returned at the customer’s expense.

Products must be returned in original packaging unless otherwise instructed.

 


 

9. Limitation of Liability

To the fullest extent permitted by law:

  • Our liability is limited to the purchase price paid for the product.

  • We are not liable for indirect, incidental, special, punitive, or consequential damages, including but not limited to:

    • Loss of use

    • Loss of profits

    • Property damage

    • Labor or installation costs

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

 


 

10. Disclaimer of Implied Warranties

Except as expressly stated, we disclaim all implied warranties to the fullest extent permitted by law, including:

  • Implied warranty of merchantability

  • Implied warranty of fitness for a particular purpose

If implied warranties cannot be disclaimed under applicable state law, they are limited to the shortest duration permitted by law.

 


 

11. Commercial Purchasers

For commercial or business purchasers:

  • All products are sold “AS IS” unless otherwise agreed in writing.

  • Our liability is strictly limited to repair or replacement of defective goods.

  • We are not responsible for economic loss, project delay, or contract penalties.

 


 

12. Chargebacks & Payment Disputes

Initiating a chargeback without first contacting us to resolve the issue may constitute a breach of our Terms of Service.

We reserve the right to dispute improper chargebacks and recover associated fees where permitted by law.
